India’s legal system is skewed against the poor…

The shocking fact is that nearly 70 per cent of India's prisoners are undertrials which means that they are waiting for their trial to begin or end. More than a quarter of these undertrials are illiterate and nearly half didn't finish school. They cannot afford bail or decent lawyers. Often, inability to afford meager bail payment of Rs 5,000 to Rs 10,000 or to arrange sureties results in poor undertrials languishing in jails for years.

The other problem is that of inordinate delay in completion of judicial proceedings on account of huge backlog of cases. About a tenth of all criminal cases have been pending for over 10 years.  Delays also occur due to multiple adjournments during hearing. The gravity of the situation can be understood from the fact that 22 million cases are pending in subordinate courts thronged by poor litigants, who bear the brunt of snail-paced justice delivery system.

Fortunately, many organisations from the legal fraternity provide succor to the poor and needy by giving free services such as legal advice, counselling, lawyers for arguing the cases, financial aid, payment towards bail etc.

Since many of the marginalized are illiterate, it is essential that they should be informed that (a) An under-trial has to be released within 60/90 days of detention if a charge sheet is not filed within this time (b) Bail is available for men in offences not punishable with death or life imprisonment and for women even for such offences (c) As per Supreme Court directives, undertrial prisoners who have served half of their probable maximum prison term must be released if trial is still ongoing.

Children in need of immediate assistance and trafficked children will be provided with legal representation, legal counselling and legal advice. The Legal Aid Cell on Child Rights will initiate prosecution the violators of the children-related law. They will also help in rehabilitation and other social integration schemes.

Criminal Justice initiative of Human Rights Law Network (HRLN)
